What happens legally if my restaurant does not pay ASCAP fees for live music?Take a look at an ASCAP press release:

They say that "During 2004, ASCAP achieved a 100% success rate with
its infringement litigation, with all concluded cases
resulting in either a cash settlement or a judgment in favor of ASCAP
members."
Below that there is a list of places which seem like restaurants and
bars. It seems ASCAP does pursue infringers, and if you don't pay for
the license ASCAP could take you to court.dreamlayers,

non-compliance that actually were prosecuted (to comprise that 100%),
